Terms of Service & Wireless Internet Access Agreement

These Terms of Service ("Terms") govern your access to and use of the wireless internet access service ("Service") provided at this location by the operator of Premium Wifi ("we," "us," "our"). By checking the box to accept these Terms and using the Service, you ("you," "user," "guest") agree to be bound by them. If you do not agree, do not use the Service.

1. The Service

The Service provides time-limited wireless internet access for a fee, for the duration you purchase (e.g., one hour or one day) or, when free access is offered, for the duration made available at no charge. The Service is offered on an "as available" basis for use at this physical location only. We do not guarantee any particular connection speed, bandwidth, latency, or uninterrupted availability, and the Service may be suspended or terminated at any time for maintenance, technical issues, or any other reason.

2. Eligibility

You must be at least 18 years old, or using the Service with the consent and supervision of a parent or guardian who agrees to these Terms on your behalf, to purchase or use the Service.

3. Acceptable Use

You agree to use the Service only for lawful purposes. Without limiting the foregoing, you agree not to use the Service to: (a) violate any local, state, federal, or international law or regulation; (b) transmit, distribute, or store any material that infringes another party's intellectual property or privacy rights; (c) transmit any unlawful, harassing, defamatory, obscene, or otherwise objectionable material, including content involving the exploitation of minors; (d) attempt to gain unauthorized access to any computer system, network, or account, or interfere with the security or proper functioning of the Service or any connected network; (e) distribute malware, viruses, or other harmful code; (f) send unsolicited bulk communications ("spam"); or (g) engage in any activity that places excessive or abusive load on the network to the detriment of other users. We reserve the right to investigate suspected violations and to cooperate with law enforcement, including disclosing relevant information, if we reasonably believe the Service has been used for unlawful activity.

4. Open Network — Assumption of Risk

Wireless networks, including this one, are inherently less secure than private, wired networks. Other users on the same network may, with sufficient effort, be able to intercept unencrypted traffic or otherwise access data you transmit. You acknowledge and accept this risk. We strongly recommend that you avoid transmitting sensitive personal, financial, or confidential information over the Service, use only encrypted (HTTPS) connections where possible, and consider using a personal VPN. You are solely responsible for the security configuration of your own device(s) and for maintaining up-to-date antivirus and security software.

5. No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, VIRUS-FREE, OR ERROR-FREE. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY DEFECTS WILL BE CORRECTED.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE, OUR OWNERS, OPERATORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, ANY DAMAGE TO YOUR DEVICE, LOSS OR THEFT OF DATA, EXPOSURE TO MALWARE OR UNAUTHORIZED ACCESS BY THIRD PARTIES, OR ANY CONTENT VIEWED, ACCESSED, OR TRANSMITTED BY YOU OR ANY OTHER USER WHILE USING THE SERVICE. TO THE EXTENT ANY LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, FOR THE SERVICE DURING THE SESSION GIVING RISE TO THE CLAIM.

7. Third-Party Content and Sites

The Service provides a connection to the internet only. We do not control, endorse, or take responsibility for any website, application, content, product, or service accessed through the Service. Your interactions with third-party sites and services are solely between you and that third party.

8. Indemnification

You agree to indemnify, defend, and hold harmless us and our owners, operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

9. Monitoring and Logging

For security, billing, and network management purposes, we may log limited technical information associated with your session, such as your device's MAC address, IP address, connection and disconnection times, and data volume. We do not inspect or log the content of your web traffic. We may access and disclose such logs if required by law, to protect our rights or property, or in connection with a suspected violation of these Terms.

10. Payment and Refunds

Paid access is billed in advance for the duration selected and is granted upon successful payment. Because access is provisioned immediately, purchases are generally non-refundable except where required by law or at our sole discretion (for example, in the case of a verified, extended service outage during your paid session).

11. Suspension and Termination

We may suspend or terminate your access to the Service at any time, without notice, if we reasonably believe you have violated these Terms, engaged in unlawful activity, or posed a risk to the network or other users. Your access will also automatically end when your purchased or allotted time expires.

12. Changes to These Terms

We may update these Terms from time to time. The version presented to you at the time you accept them governs your session. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms for future sessions.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles, except to the extent superseded by applicable federal law or mandatory consumer-protection laws of the jurisdiction in which you reside or in which the Service is physically provided.
